CANNABIS DISPENSARY REGULATIONS FOR WYOMING
Wyoming does not license cannabis dispensaries or allow commercial marijuana sales. The state has no medical cannabis program, and recreational marijuana remains illegal.
As a result, Wyoming has no licensing system for marijuana cultivation, manufacturing, testing, delivery, or retail sales. State and local law enforcement agencies enforce these restrictions under Wyoming’s controlled substance laws.
Marijuana Possession and Penalties
Wyoming classifies marijuana as a controlled substance. Therefore, possessing, growing, processing, or selling marijuana can lead to criminal charges.
Possession of up to three ounces of marijuana in plant form is a misdemeanor. The penalty may include up to 12 months in jail, a fine of up to $1,000, or both. However, a third or later offense can result in up to five years in prison and a fine of up to $5,000.
Possessing more than three ounces in plant form may result in felony charges. In addition, Wyoming uses separate weight limits for liquids, powders, pills, and other forms of controlled substances. Wyoming Statutes § 35-7-1031
The state also prohibits home cultivation. A person who knowingly grows, harvests, dries, or processes marijuana may face up to six months in jail, a fine of up to $1,000, or both.
Medical Cannabis Status
Wyoming does not operate a state medical cannabis program. Patients cannot receive medical cannabis cards, purchase marijuana from licensed dispensaries, or grow cannabis for medical use.
Furthermore, a doctor cannot authorize marijuana under a Wyoming medical cannabis program because no such program exists. Federal approval of certain prescription drugs containing cannabinoids does not create broader legal access to medical marijuana.
Hemp, CBD, and Intoxicating Cannabinoids
Wyoming permits hemp and hemp products that meet state requirements. The Wyoming Department of Agriculture oversees the state’s hemp program, including licensing, sampling, testing, and production rules. Wyoming Department of Agriculture Hemp Program
However, Wyoming’s hemp rules are stricter than a simple delta-9 THC limit. Since July 1, 2024, the state has prohibited hemp products that contain synthetic THC, synthetic cannabinoids, or other synthetic psychoactive substances.
Wyoming also defines THC to include certain psychoactive analogs and isomers. Therefore, products containing delta-8 THC or similar intoxicating cannabinoids may fall outside the state’s legal definition of hemp, even when they originate from federally lawful hemp.
Legal hemp products must contain no more than 0.3% THC on a dry-weight basis under the state’s testing standard. Businesses may not add synthetic psychoactive substances to those products. Wyoming Senate File 32
Dispensary and Business Restrictions
Wyoming offers no legal path for marijuana dispensaries, delivery services, commercial growers, or marijuana processors. Likewise, the state does not issue licenses for plant-touching marijuana businesses.
Hemp and CBD businesses may operate if their products and activities follow state and federal law. Still, operators must carefully review product formulas, testing results, labels, marketing claims, and licensing requirements.
Payment providers may also treat hemp and cannabinoid businesses as high risk. For example, they may review product ingredients, laboratory reports, marketing practices, chargeback history, and state availability before approving an account.

CANNABIS LEGALIZATION HISTORY IN WYOMING
Wyoming has maintained strict marijuana prohibition for decades. Although lawmakers and advocacy groups have proposed reform, the state has not created a medical or recreational cannabis market.
In 2020, Wyoming established a state hemp program after receiving federal approval. The Wyoming Department of Agriculture then began accepting license applications and overseeing hemp production.
Lawmakers took a more restrictive approach to intoxicating hemp products in 2024. Senate File 32 expanded the definition of THC, prohibited synthetic substances in hemp products, and restricted products containing psychoactive THC compounds.
In 2025, lawmakers considered a proposal to regulate consumable hemp manufacturers, distributors, and retailers. However, the House did not consider the bill for introduction. Wyoming House Bill 267
A separate 2026 proposal would have moved marijuana to Schedule III under state law. However, lawmakers did not consider that bill for introduction either. Therefore, it did not change Wyoming’s marijuana laws. Wyoming House Bill 166
