CANNABIS DISPENSARY REGULATIONS FOR WISCONSIN
Wisconsin does not license cannabis dispensaries, growers, processors, or other marijuana businesses. The state also lacks a full medical cannabis program. Therefore, commercial marijuana sales remain illegal for both medical and recreational use.
State and local law enforcement agencies enforce Wisconsin’s controlled substance laws.
Limited Medical CBD Exception
Wisconsin provides a narrow exception for certain CBD products. A person may possess an eligible CBD product to treat a medical condition if a Wisconsin doctor provides written certification.
The document must identify the doctor and patient. It must also state that the patient uses CBD to treat a medical condition. In addition, the doctor must have issued the certification within the previous year.
However, this exception does not create a patient registry or allow dispensaries. It also does not provide patients with a legal in-state supply system.
Wisconsin defines an eligible CBD product as a cannabis-derived product that contains CBD without enough delta-9 THC to cause a psychoactive effect. Still, this medical exception differs from the laws that apply to hemp products. Wisconsin Statutes § 961.32
Hemp and CBD Businesses
Hemp falls outside the state’s definition of marijuana when it meets state and federal requirements. These rules include limits on THC concentration.
Wisconsin ended its state hemp licensing program on January 1, 2022. As a result, Wisconsin hemp growers now apply for licenses through the U.S. Department of Agriculture.
Meanwhile, the Wisconsin Department of Agriculture, Trade and Consumer Protection continues to oversee consumer protection, food licensing, retail licensing, product measurements, and some labeling rules. Wisconsin DATCP hemp resources
CBD and hemp businesses must consider more than the THC level of the original plant. For example, product formulas, testing results, labels, marketing claims, and added cannabinoids can all affect whether a product complies with the law.
Dispensary and Business Restrictions
Wisconsin offers no legal path for marijuana dispensaries, delivery services, commercial growers, or processors. Selling marijuana flower, concentrates, or infused products outside the state’s limited exceptions remains illegal.
The state also prohibits home marijuana cultivation. In addition, marijuana possession can lead to criminal penalties under state law. Some cities have reduced local penalties or placed a lower priority on enforcement. However, those local policies do not legalize marijuana statewide. Wisconsin Statutes § 961.41
Hemp and CBD businesses may also face payment processing challenges. Payment providers often review product ingredients, marketing practices, compliance records, chargeback risk, and other business details before approving an account.

CANNABIS LEGALIZATION HISTORY IN WISCONSIN
Wisconsin has continued to prohibit marijuana while creating limited exceptions for certain CBD products.
In 2014, lawmakers passed Wisconsin Act 267. The law created a narrow CBD exception that mainly applied to people with seizure disorders. However, it did not allow commercial cultivation, manufacturing, dispensaries, or an in-state supply system. 2013 Wisconsin Act 267
Lawmakers expanded the exception through Wisconsin Act 4 in 2017. The updated law allowed people to possess certain CBD products for any medical condition with written certification from a doctor. Even so, the legislation did not create a full medical cannabis program. 2017 Wisconsin Act 4
Later, Wisconsin updated its hemp laws following changes at the federal level. The USDA then took over hemp grower licensing after Wisconsin ended its state program in 2022.
Since then, lawmakers have introduced several medical and adult-use cannabis proposals. As of September 2026, though, they have not passed a full medical cannabis or recreational marijuana program.
