CANNABIS DISPENSARY REGULATIONS FOR RHODE ISLAND

Rhode Island allows both medical and recreational cannabis sales. The Rhode Island Cannabis Control Commission oversees licensing, regulation, and enforcement.

The Cannabis Office handles many daily program functions. These include licensing, compliance, medical cannabis oversight, and plant tagging.

The Rhode Island Department of Health also regulates cannabis testing and manages parts of the medical marijuana program.

Retail License Types

Rhode Island has several types of cannabis retail licenses.

Hybrid cannabis retailers may sell cannabis to medical patients and recreational customers. However, this authorization is generally limited to licensed compassion centers.

The state is also issuing new adult-use retail licenses. These licenses fall into three groups:

  • General cannabis retail licenses
  • Social equity retail licenses
  • Workers’ cooperative retail licenses

Medical cannabis dispensaries are known as compassion centers in Rhode Island. They serve registered patients and authorized purchasers. A compassion center must receive separate authorization before it can make adult-use sales.

New Adult-Use Retail Licenses

The Rhode Island Cannabis Act allows the Cannabis Control Commission to issue 24 new retail licenses.

The state divides these licenses among six geographic zones. Each zone may receive up to four new retailers:

  • Two general retailers
  • One social equity retailer
  • One workers’ cooperative retailer

These licenses are separate from the state’s existing hybrid cannabis retailers.

Rhode Island opened the application portal for new adult-use retail licenses on August 7, 2026. Applications must be submitted by November 23, 2026.

Applicants can review the requirements through the state’s adult-use retail licensing portal.

Application and License Fees

The application fee for a general adult-use retail license is $7,500. This fee is nonrefundable.

Approved retailers must also pay a $30,000 annual license fee before receiving a final license.

Workers’ cooperative applicants generally face the same application and annual license fees.

However, the state waived the application fee for its first six social equity retail licenses. The annual fee is also waived during the first year for those businesses. It then increases gradually until it reaches $30,000 in the fifth year.

Existing compassion centers must pay a $30,000 annual authorization fee to operate as hybrid cannabis retailers.

Business and Location Requirements

Applicants must provide detailed information about their proposed business. This includes funding sources, ownership, staffing, operations, security, inventory control, and community safety.

Retail applicants must also submit:

  • A detailed business plan
  • A security and cash-management plan
  • An inventory tracking plan
  • Packaging and labeling procedures
  • An advertising and marketing plan
  • A product recall plan
  • Proof of local zoning approval
  • Ownership or lease documents for the property
  • Information about owners, investors, and managers

New retail locations must generally remain at least 500 feet from an existing public or private school.

In addition, Rhode Island municipalities may prohibit cannabis retailers through a local referendum. Applicants should confirm local eligibility before signing a lease or investing in a property.

Retail Operations and Compliance

Licensed cannabis retailers must follow strict operating rules. These rules cover security, surveillance, employee registration, inventory, testing, packaging, advertising, and recordkeeping.

Cannabis products must pass laboratory testing before they can be sold. Testing requirements cover potency and potential contaminants.

Retailers must also maintain procedures for defective, damaged, expired, or recalled products. The Cannabis Control Commission may inspect licensed facilities to confirm compliance.

Cannabis Taxes

Adult-use cannabis purchases are subject to a combined tax rate of 20%. This includes:

  • Rhode Island’s 7% sales tax
  • A 10% state cannabis excise tax
  • A 3% local cannabis excise tax

Medical cannabis sales are not subject to the state and local cannabis excise taxes. However, other taxes and medical program surcharges may still apply.

Banking and Payment Processing

Cannabis remains restricted under federal law. Therefore, Rhode Island cannabis businesses may have difficulty accessing traditional banking and payment services.

Retail applicants must describe their cash-management and electronic payment policies. They must also provide a plan for obtaining a secure deposit account before opening.

CANNABIS LEGALIZATION HISTORY IN RHODE ISLAND

Rhode Island legalized medical cannabis in 2006. The state later created compassion centers to provide regulated access for registered patients.

In 2013, Rhode Island decriminalized possession of small amounts of cannabis. This change replaced some criminal penalties with civil fines.

Governor Daniel McKee signed the Rhode Island Cannabis Act on May 25, 2022. The law legalized cannabis possession and home cultivation for adults aged 21 and older.

Adult-use retail sales began on December 1, 2022. At first, approved compassion centers entered the recreational market as hybrid cannabis retailers.

The Cannabis Act also created a Cannabis Control Commission. In addition, it reserved new retail opportunities for social equity applicants and workers’ cooperatives.

Rhode Island began accepting applications for its next group of adult-use retailers in August 2026.

CANNABIS LEGALIZATION STATUS IN RHODE ISLAND

Current Status: Legal for both medical and recreational use

Rhode Island law allows:

  • Adults 21 and older to buy cannabis from licensed retailers
  • Possession of up to one ounce of cannabis in public
  • Possession of up to 10 ounces at home
  • Home cultivation of up to three mature and three immature plants, subject to household and security rules
  • Registered patients to obtain cannabis through the medical program
  • Licensed cultivation, manufacturing, testing, and retail sales

Cannabis use remains prohibited in public places and other locations where smoking or vapor use is not permitted. Cannabis also cannot be transported across state lines.

Rhode Island’s market is entering a major expansion period. The new retail licensing process should increase participation while preserving the state’s focus on social equity, local control, and consumer safety.
