The Oregon Health Authority (OHA) oversees a licensing system for the manufacturing, transportation, delivery, sale, and purchase of psilocybin products, as well as the provision of psilocybin services. Unlike cannabis, psilocybin consumption is restricted to licensed service centers and must be supervised by state-certified facilitators who have undergone specific training and met qualifications set by the state.

The regulations stipulate that only individuals 21 and older can use psilocybin in these supervised settings. Businesses in this industry face strict oversight of psilocybin production, manufacturing requirements, mandatory testing for purity and potency, and meticulous record-keeping. Interestingly, counties and municipalities in Oregon have the option to opt out of allowing psilocybin-related businesses, adding another layer of consideration for potential industry participants.

Legalization History of Psychedelics in Oregon

Oregon’s journey to psychedelic legalization has been progressive and multifaceted. In November 2020, the state became a pioneer by legalizing psilocybin-assisted therapy through Measure 109. This groundbreaking legislation was followed by a two-year development period where the OHA collaborated with the Oregon Psilocybin Advisory Board to establish comprehensive rules and regulations. The implementation began on January 2, 2023, when the state started accepting applications for psilocybin-related businesses.

Concurrent with Measure 109, Oregon passed Measure 110, which decriminalized the personal possession of small amounts of drugs, including various psychedelics, effective February 1, 2021. This comprehensive approach to drug policy reform positions Oregon as a leader in progressive drug legislation. The state continues to refine its policies, as evidenced by the introduction of SB 1580 in 2022, which aims to address equity and access issues in the psilocybin services program.

As the first state to allow legal use of psilocybin for adults starting January 1, 2023, Oregon’s model is being closely watched and could potentially influence future legislation in other states across the country.
